There is usually some administration required following a death in order to deal with the deceased’s financial affairs.
Each case is different but it is important to be aware of various legal rules (such as the legal rights of spouses and children) to ensure the administration is properly carried out. Otherwise an executor may find he or she has distributed the estate incorrectly.
Some estates (for example usually where a house is owned) will require Confirmation (Probate) to be obtained from the sheriff court. Most families use a solicitor to do this for them.
